Code Enforcement Citations & Fee Schedule for Violations

On June 4, 2018, the Town Commission adopted Ordinance 2018-03 and passed Resolution 2018-11, which amends Town Code, Chapter 33, Code Enforcement, allowing for an additional enforcement tool by implementing a Civil Citation process and setting fees for certain Code violations.

This new Civil Citation process addresses the type of infractions that are point-in-time, transient, or irreversible in nature.  The violations and Town Code references are:

•          Non-Compliance with Short-Term Vacation Rental requirements – Town Code, Chapter 158

•          Non-Permitted Construction Activity – Town Code, Chapter 150

•          Non-Compliance with Marine Turtle Protection Regulations – Town Code, Chapter 100

•          Non-Permitted Commercial Activity on Town-owned Property – Town Code, Chapter 92

Violations of these Town Ordinances may result in the issuance of a civil citation, with fines of $100.00 for the First Offense, $250.00 for the Second Offense, and $500.00 for the Third and Subsequent Offences, and in which a separate civil citation may be issued for each calendar day the violation occurs. Some violations, such as those related to short term-vacation rental regulations, may result in one or more citations – to the owner, renter, and rental agent.
